Claim terms
What you agree to when you confirm your results and sign your forms.
In short: our fee is 40% of your refund plus VAT (48% in total, minimum £42). We take it from the refund and send you the rest. No refund, no fee. You can cancel within 14 days at no cost.
These terms apply when you confirm your results and sign your 64-8 and P87 forms. They form a contract between you and Reclaim My PPI Tax Ltd, trading as MLD Tax Group ("we", "us"). The contract starts when you sign.
1. What we will do
- Prepare your P87 claim for flat-rate work expenses, using your HMRC record and the details you've confirmed.
- Send you your 64-8 and P87 forms to sign online through Signable.
- Print and post your signed claim to HMRC.
- Deal with HMRC about your claim on your behalf, and act in your best interests in doing so.
- Receive your refund from HMRC, take our fee and pay you the rest.
We only claim overpaid tax in the UK. We will carry out the service with reasonable care and skill and in a timely manner.
2. What you agree to
- The results you confirm are correct to the best of your knowledge.
- Your employer has not already paid you back for these expenses.
- You haven't already claimed these expenses for the same tax years, yourself or through another agent.
- You'll tell us straight away if anything changes or HMRC contacts you about the claim.
- You'll give us clear instructions and co-operate with us when we ask.
- You'll give us your bank details, and any identity documents we ask for, before we pay you.
We rely on the information you give us being true, correct and complete. If it is wrong, HMRC may reduce or refuse your claim, or you could end up owing HMRC tax.
3. Our fee
- If you are due a refund, our fee is the greater of 40% of your refund plus VAT (48% in total at the current VAT rate) or £35 plus VAT (£42).
- If your refund is less than £42, our fee is limited to the amount of your refund.
- No win, no fee. If you are not due a refund, we do not charge a fee.
- If we receive more than one refund for you in a tax year (6 April to 5 April), we work out our fee on the total of those refunds.
Example. If HMRC refunds £200, our fee is £96 (£80 plus £16 VAT) and you receive £104.
"Refund" means the total HMRC pays or credits for the claim, including any interest and any amount HMRC uses to reduce tax you owe.
4. How you are paid
- By signing your P87 you nominate us to receive your refund from HMRC.
- When HMRC sends the refund to us, we take our fee, send you an invoice showing the fee, and pay you the balance within 5 working days of receiving both the refund and your bank details.
- We carry out security checks before making a payment, including checking your identity. We may be unable to pay you until these checks are passed.
- If HMRC sends the refund straight to you or to someone else, or adjusts your tax code instead, we will send you an invoice for our fee. It is payable within 28 days.
- It is your responsibility to give us the correct bank details. We make reasonable checks that the details match, but we are not responsible for your loss if the details you gave were wrong.
5. Other charges
- Payments from HMRC that aren't part of your claim. If HMRC sends us a payment for you that is unrelated to a claim we made, we will pass it to you less an administration fee of up to £60 including VAT.
- Replacement payments. If you ask us to reissue a payment, we may charge an administration fee of up to £36 including VAT to cover our costs, including bank charges.
- Late payment. If you owe us a fee and don't pay it on time, we may charge interest at 4% a year above the Barclays Bank base rate, from the due date until you pay. If you dispute a fee in good faith and tell us promptly, interest does not apply to the disputed amount while it is in dispute.
- Unpaid fees. We may take steps to recover unpaid fees. This can include deducting them from future refunds we receive for you, passing your details to a debt recovery service, or legal action. You may be liable for the recovery company's charges.
6. Problems with a payment, and unclaimed refunds
- You have 6 months from the date we issue a payment to tell us in writing about any problem with it or to ask for a replacement. After that we may be unable to help.
- We will ask you for your bank details a reasonable number of times. If you do not give them within 6 months, or a cheque we have issued is not cashed within 6 months, we reserve the right to cancel the payment and keep the whole refund.
7. Your right to cancel
- You can cancel within 14 days of signing, without giving a reason and at no cost.
- To cancel, use the cancel link in any message we've sent you about your claim, fill in our online cancellation form, or tell us by email or post.
- If HMRC has already paid a refund to us before your cancellation takes effect, we'll pay it to you in full.
8. Ending the agreement after 14 days
- Either of us can end this agreement at any time by giving notice in writing.
- Our fee still applies to any claim we sent to HMRC before the agreement ended.
- If we ask you for information or paperwork and don't receive it within 28 days, we may treat that as you ending the agreement.
9. Claims over £2,500
HMRC does not accept a P87 where expenses are more than £2,500 for a tax year. Those claims must be made through Self Assessment. If this applies to you, we'll tell you and we won't submit that tax year on a P87.
10. Our authority with HMRC
The 64-8 form authorises us to deal with HMRC for you. We keep this authority in place after your claim so our staff can speak to HMRC on your behalf about it. You can ask us to remove it at any time, or remove it yourself with HMRC.
11. Signing your forms
We send your forms by a secure link. Each link stays open for 30 days. If you don't sign, we'll resend the link up to twice. After that we stop, and your claim does not go ahead unless you contact us.
12. What we can't promise
HMRC decides whether to pay your claim, how much and when. We can't guarantee an amount or a timescale. Any figure in your results is an estimate. Because timings depend on HMRC, you agree that we may not be able to complete the service within 30 days.
13. Tracking your claim
We'll update you at each of these stages:
- Printed. Your claim has been printed.
- Posted. Your claim has been sent to HMRC.
- HMRC outcome. HMRC has made its decision.
- Refund received. HMRC has paid your refund to us.
- Fee invoiced. We've taken our fee, sent your invoice and paid you the balance.
14. How we contact you
We'll contact you by text and email, and by post where we need to. To contact us, email info@reclaimmyppitax.co.uk.
15. Our responsibility to you
- If we are negligent or deliberately break this agreement, we are liable to you for your direct losses, up to the amount of the fees we received from you.
- We are not liable for loss of profit, loss of business or other indirect losses.
- We are not liable for losses caused by false, misleading or incomplete information, or by anyone other than us.
- We are not liable for HMRC penalties for late or inaccurate filings unless we negligently caused the delay or inaccuracy.
- We are not responsible for any tax assessment or debt that HMRC may pursue, or for telling you about fines or penalties where we reasonably believe HMRC has contacted you directly.
- We don't take responsibility for returning documents you send us in support of a claim.
Nothing in these terms limits our liability for fraud or dishonesty, your legal rights as a consumer, or any liability that the law says can't be limited.
16. Your information and confidentiality
We use your information as set out in our privacy notice. We keep claim records for at least 6 years. We won't disclose confidential information about you to anyone else without your consent, unless the law, a court, HMRC or another regulator requires it.
17. General
- If we need to change these terms, we will tell you in writing.
- Nobody other than you and us has rights under this agreement.
- If any part of these terms is found to be invalid, the rest still applies.
- These terms are the whole agreement between you and us for this claim.
18. Complaints and law
If you're unhappy, email info@reclaimmyppitax.co.uk or write to us at 96 Broadway, Chadderton, Oldham, OL9 0AA. We'll look into it carefully and promptly. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
